Terms of use

This English version is provided for convenience. In case of discrepancy, the French version prevails.

1. Purpose

These terms of use (the "Terms") govern access to and use of Cinedex, a free online collectible card game about films, series, animation, talent and studios. The service is published by a private individual (identity held by the hosting provider) (the "publisher"), whose details are given in the legal notice.

By creating an account, you confirm that you have read and accepted these Terms and the privacy policy.

2. Access and registration

  • Minimum age: registration is restricted to people aged 15 or over. If you are under 18, you confirm that you play with the consent of your parents or legal guardian.
  • Invitation only: during the "friends" phase, a personal single-use invitation code is required. Each player has a limited number of codes (5) and shares them, under their own responsibility, with people they know. The inviter and the invitee become friends in the game.
  • One account per person. Your account is personal. Choose a username that does not infringe anyone's rights or impersonate anyone. Keep your password secret; any action taken from your account is presumed to be yours.
  • No email address is requested: a forgotten password cannot be recovered automatically. Keep it safe.

3. The game, currencies and cards

  • No real money. The game is entirely free. Boosters, cards and in-game currency cannot be bought with real money, and no real-world prize can be won.
  • Virtual currencies. "Tickets" and "film stock" (pellicule) are game units. They have no monetary valueand are not refundable, convertible or transferable outside the game.
  • Virtual cards. Cards, their finishes and serial numbers are game items. Players hold a mere personal right to use them within the game; they acquire no ownership of them or of the images they reproduce. Cards are not official products of the works or people depicted.
  • Chance and balancing. Booster contents are drawn at random according to the rates shown in the game. The publisher may change rates, prices, market or workshop rules to keep the game balanced, without any right to compensation.
  • Trades and market. Trades take place between friends, and auctions are in tickets only, under the rules shown in the game.

4. Code of conduct

It is forbidden:

  • to sell, buy or rent for real money (or any other benefit outside the game) an account, cards, tickets, film stock or invitation codes, including on third-party websites;
  • to create or use several accounts to gain an advantage, in particular to move cards or tickets to another account, or to share or transfer your account. To prevent this, a new account cannot give much more than it receives in a trade, and a card cannot be auctioned below its recycle value;
  • to use bots, scripts or automated programs, to exploit a bug instead of reporting it, or to circumvent game limits;
  • to post, in a username, bio, message or trade, insulting, defamatory, hateful, discriminatory, violent or pornographic content, harassment, other people's personal data, advertising or any unlawful content;
  • to impersonate anyone or pose as the publisher, an administrator or a rights holder;
  • to interfere with the operation or security of the service (intrusion, overload, mass data collection).

5. Content posted by players

You are responsible for the content you post (username, bio, messages, trade notes). You authorise the publisher to display it in the game while it is published. For such content, the publisher acts as a hosting provider: it does not review it beforehand, but promptly removes content reported to it that is manifestly unlawful or contrary to these Terms.

Private messages are only read by the publisher when a message is reported, for moderation purposes, or upon a lawful request from an authority.

6. Intellectual property and third-party content

  • Film and people data, posters, photos and logos come from The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB.
  • Posters and artwork belong to their studios, distributors and designers; photographs to their photographers; people depicted keep their personality and image rights; titles, names and logos are trademarks or names of their owners. Cinedex is not affiliated with any of them.
  • Any rights holder or person depicted can have content removed (section 7). Removing a card hides its artwork throughout the game; copies already owned remain in collections in a neutral form.
  • Cinedex's own code, layout, texts and graphic elements belong to the publisher.

7. Reporting and removal

  • Players: "Report" button on every card page and every player profile.
  • Without an account (rights holders, people depicted, third parties): removal request form, or write to contact@cinedextcg.com.
  • Every report is reviewed as quickly as possible. The reporter is informed of the decision and its reasons. A decision to remove player content or to sanction a player is also notified, with reasons, to the player concerned, who may contest it by writing to the contact address.
  • Repeated abusive or manifestly unfounded reports may no longer be processed.

8. Sanctions

In case of breach of these Terms, the publisher may, in proportion to the seriousness of the breach: remove content, issue a warning, cancel gains obtained irregularly, or suspend the account temporarily or permanently. Decisions are reasoned and may be contested by writing to contact@cinedextcg.com. A suspension gives no right to compensation, as game items have no monetary value.

9. Liability

The service is provided free of charge, "as is", by a small project. The publisher makes its best efforts to keep it running but does not guarantee permanent availability, the absence of errors or the indefinite retention of game data. To the extent permitted by law, it is not liable for interruptions, loss of game data, errors in TMDB data or the conduct of other players. Nothing in these Terms limits the rights that mandatory law grants to consumers.

10. Changes to the service and the Terms

The publisher may change the game, its rules and these Terms. Any significant change to the Terms is announced in the game at least 15 days before it takes effect; if you do not accept it, you may delete your account before that date. The publisher may also discontinue the service; it will announce this at least 30 days in advance where possible, and you will be able to export your data until closure.

11. Account deletion

You can delete your account at any time from the My account page, after confirming your password. Deletion is final: your cards leave circulation, your pending trades are cancelled, and your personal data is erased or anonymised as described in the privacy policy. If you are leading an auction or one of your sales has already received a bid, deletion becomes possible once those auctions close.

12. Governing law

These Terms are governed by French law. In case of dispute, an amicable solution is sought first by writing to contact@cinedextcg.com. Failing that, the courts designated by law have jurisdiction.
